These Terms of Use ("Terms") govern your use of the Whispry website (getwhispry.live) and related services. By accessing or using our website and services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing our website, creating an account, or purchasing Whispry software, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use our services.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use our services. By using our services, you represent and warrant that you meet this requirement.

3. Account Registration

To purchase Whispry, you must create an account. You agree to:

Provide accurate and complete information
Maintain the security of your account credentials
Notify us immediately of any unauthorized access
Accept responsibility for all activities under your account

4. Purchases and Payment

All purchases are processed through Stripe. By making a purchase, you agree to:

Pay all applicable fees and taxes
Provide valid payment information
Accept Stripe's terms of service

Prices are listed in USD and are subject to change without notice. However, once you complete a purchase, your price is locked in.

5. Refund Policy

We offer refunds under the following conditions:

Within 14 days of purchase: Full refund if you have not activated the license
Technical issues: Full refund if the software does not function on your supported Mac and we cannot resolve the issue

To request a refund, contact support@getwhispry.live with your order details.

Note: Refunds are not available after 14 days or if you have already activated your license on any device, except for documented technical issues.

6. User Conduct

You agree not to:

Violate any applicable laws or regulations
Attempt to reverse engineer, decompile, or disassemble the software
Share, sell, or transfer your license to others
Use automated systems to access our services
Interfere with the proper operation of our services
Attempt to bypass license validation or security measures

7. Intellectual Property

All content on our website, including text, graphics, logos, and software, is the property of Whispry or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

8. Disclaimer of Warranties

OUR WEBSITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that our services will be uninterrupted, error-free, or completely secure.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHISPRY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES.

Our total liability shall not exceed the amount you paid for the software in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Whispry and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these Terms.

11. Termination

We may suspend or terminate your account and access to our services at any time, with or without cause, and with or without notice. Upon termination, your license to use the software remains valid per the EULA, but you may lose access to account services.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

13. Dispute Resolution

Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration authority.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or by posting a notice on our website. Your continued use of our services after such changes constitutes acceptance of the modified Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
